These are the general terms and conditions of fairfuneral.uk (“the website”), a trading name of fairfuneral.uk

By accessing the website and/or communicating with us, you consent to the following terms and conditions of use. If you do not agree with these Terms of Use or fairfuneral.uk’s Privacy Policy you cannot use the website and we will remove your details from it.

Purpose of the website

The purpose of the website is to connect you with local independent funeral directors and, where applicable, provide you with pricing relating to funeral services as outlined in the Funerals Market Investigation Order 2021. The content of the website is provided for general information purposes and to provide visitors with information on funeral services available in specific locations. Any services or contracts agreed with a funeral director listed on the website will not involve fairfuneral.uk.

The Funeral Notices section of the website provides a way for bereaved families and friends to share tributes to deceased persons and provide details of the arrangements of their funeral and associated events.

The website also allows you to review the service that you have received from a local independent funeral director who’s associated with the website.

Use of the website

We cannot accept liability for any loss of any kind as a result of reliance on the information provided on the website or any other website which can be accessed by a link from the website or the functioning of the website (see below for links to the website policy). The content of the website is subject to change without notice.

Views and opinions expressed in user generated content “content” (such as a Memory on a Funeral Notice) submitted by members of the public are those of the individual submitting the content, not those of fairfuneral.uk or any funeral director associated with the website, therefore we accept no responsibility for such content

We exclude to the fullest extent permitted by law, all liability for any claims, penalties, losses, damages, costs or expenses arising from the use of, or inability to use, the website or from any unauthorised access to or alteration of the website.

Links to the website

You are permitted to create a link from your website to the homepage of the website providing you do not link to the website from any site containing obscene, defamatory, threatening, inflammatory or degrading material or material which infringes the intellectual property or other rights of any third party or which is otherwise unlawful. Funeral Notice Information

Friends or family of the deceased are responsible for all content uploaded to Funeral Notices. As such, by uploading content, the person providing the content confirms they are the exclusive owner of all content added and any content added will not infringe, misappropriate or violate a third party’s trademark, patent, copyright or other intellectual property rights or result in the violation of any applicable laws.

Funeral director reviews

You can review the services received by a local funeral director when you have had direct service from them. You can only write about your own experience, the review should not be based on what you have heard from a third party such as a family member or friend.

You may not review a business that you have a financial interest in, are employed by or that is a competitor of your own business.

We do not monitor reviews that are submitted to the website.

Security Policy

We make every effort to maintain customer confidentiality and security when making any transactions. This includes taking steps to ensure the security of your personal information. Our practice reflects current security standards. As no purchases may be made online from the website, no bank and/or credit card details will be taken.

Privacy Policy

We respect your privacy and are firmly committed to protecting your information. The law places certain obligations on us and we have put further procedures in place so that the data you provide will only be used in a lawful and fair way and that we will never mislead you about the use of your data. You can be sure that we will never pass on your information to third parties except where this is necessary for service fulfilment purposes or unless required to do so by law. There is no charge for your use of or access to the website and we will not accept, hold, process or transfer any sums for or from you or on your behalf, including by way of making payments to any funeral director.

We will not provide advice (including financial advice) in relation to any product or service, including any funeral arrangements, through the website. We are not responsible for any funeral arrangements and only the funeral director chosen by you is responsible to you for them. We do not guarantee that the funeral director(s) we identify for you will offer the best or the cheapest or most cost effective service. We only operate with funeral directors within the Golden Charter network and not all local funeral directors will be within that network.

The service provided by the website does not involve funeral planning and/or the entering into of funeral planning contracts.

The final price and payment details for any chosen funeral arrangements must be agreed between you and your chosen funeral director. We will have no involvement in or responsibility for that and there will be no contract between you and us in relation to any funeral arrangements.

You are under no obligation to proceed with any funeral arrangements and/or to enter in to a contract with any funeral director whose details appear on the website. You are free to decide not to proceed even after speaking to the funeral director.

We are not responsible for the service provided by any funeral director or for resolving any complaints or dispute. If you have a complaint about your funeral director or are in any dispute with them we recommend that you follow their complaints procedure which they will provide to you. We can tell you whether your funeral director is a member of a professional trade body and therefore whether you can use their complaints or dispute resolution procedures instead or in addition.

The pricing provided on the website relating to the provision of funeral services outlined in The Funerals Market Investigation Order 2021 (“the Order”) is not, nor is it intended to be, contractually binding either on you or on any funeral director. Funeral directors are obliged under the Order to display price information on their website(s) and at their branches and also display their terms of business and disclose other details about their business and interests. Any details provided by a funeral director on the website are in addition to and not in substitution for the information they must provide to you under the Order. We are not responsible for any funeral director’s compliance with the terms of the Order.
